FreeBudget Terms of Service

These Terms of Service ("Terms") govern your use of the FreeBudget application and website (collectively, the “Service”), operated by Budget Social Inc (“FreeBudget”, “we,” “our,” or “us”). By using FreeBudget, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using FreeBudget, you represent and warrant that you meet these requirements. The Service is intended for U.S. residents only.
2. Account Registration
You must create an account to use FreeBudget. You agree to provide accurate, current, and complete information and to keep it updated. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
3. Acceptable Use
You agree not to:
- Use FreeBudget for any unlawful, fraudulent, or malicious purpose
- Access, use, or attempt to access or use data that does not belong to you
- Interfere with or disrupt the Service or its infrastructure
- Use any bots, scrapers, or automated tools to access the Service or extract data
We reserve the right to suspend or terminate accounts that violate these guidelines.
4. Financial Data Integration
FreeBudget allows you to connect to financial institutions through Plaid Inc. By using this feature, you authorize FreeBudget and Plaid to access and transmit your financial data from connected accounts. Use of this feature is subject to Plaid’s Privacy Policy. A small fee may apply for linked accounts to cover Plaid’s secure connection costs; FreeBudget does not profit from these charges.
You acknowledge and agree that FreeBudget is not responsible for the accuracy, completeness, or availability of data retrieved through Plaid or other means. We do not control or audit data provided by third parties.
5. License & Intellectual Property
We grant you a limited, non-exclusive, non-transferable, and revocable license to use FreeBudget for personal, non-commercial purposes. All intellectual property rights, including trademarks, content, and software, are owned by FreeBudget. You may not reproduce, distribute, modify, reverse-engineer, or exploit any part of the Service without our written permission.
6. Fees and Payment
FreeBudget is free to use for most features. However, certain services, such as linking your bank accounts through Plaid, may incur a small fee to cover the cost of secure third-party integration.
We do not profit from these fees. You’ll be notified before any charges are incurred, and payment will be processed through a secure third-party provider.
You are responsible for all applicable taxes and charges associated with your use of paid services. FreeBudget reserves the right to change fees with advance notice.
7. Termination
You may delete your account at any time by contacting support@freebudget.org. We may suspend or terminate your access to the Service at our discretion, with or without notice, including for violations of these Terms.
Provisions that by their nature should survive termination (such as indemnification, disclaimers, and limitations of liability) shall survive.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that FreeBudget will be error-free, uninterrupted, or that financial data will be accurate or complete. You use the Service at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, FreeBudget will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of FreeBudget. Our total liability for any claim will not exceed the amount you paid us, if any, in the three (3) months before the claim arose.
10. Indemnification
You agree to defend, indemnify, and hold harmless FreeBudget and its affiliates, officers, and employees from and against any claims, damages, liabilities, and expenses arising out of your use of FreeBudget or your violation of these Terms.
11. Modifications
FreeBudget may update or modify these Terms at any time, at its sole discretion. We are not obligated to provide prior notice of such changes. Any updates will become effective immediately upon posting unless otherwise specified.
We encourage you to review these Terms periodically. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law principles. Any disputes will be resolved exclusively in the courts located in South Carolina.
13. Dispute Resolution and Arbitration
Any disputes arising from or relating to these Terms or your use of FreeBudget will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court.
You agree to waive your right to a jury trial and to participate in class actions. All disputes will be resolved individually. This agreement to arbitrate survives account termination.
The arbitration will be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA), and held in South Carolina.
