FreeBudget Terms of Service

These Terms of Service (“Terms”) govern your use of the FreeBudget application and website (collectively, the “Service”), operated by Budget Social Inc (dba “FreeBudget,” “we,” “our,” or “us”). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. The Service is intended for U.S. residents only.

2. Account Registration

You must create an account to use certain features. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account.

3. Acceptable Use

You agree you will not:

  • Use the Service for unlawful, fraudulent, or malicious activity;

  • Access or attempt to access data that does not belong to you;

  • Interfere with or disrupt the Service or its infrastructure;

  • Use bots, scrapers, or automated tools to access the Service or extract data.
    We may suspend or terminate accounts that violate these Terms.

4. Financial Data Integration (Plaid)

FreeBudget enables connections to your financial institutions via Plaid Inc. By using this feature, you authorize FreeBudget and Plaid to access, transmit, and process your financial data from connected accounts. Your use of Plaid is subject to Plaid’s terms and privacy policy.
You acknowledge FreeBudget is not responsible for the accuracy, completeness, or availability of third-party data (including Plaid and your institutions) and does not audit or control such data.

5. License & Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. FreeBudget and its licensors own all rights in the Service. You may not copy, distribute, modify, reverse-engineer, or exploit any part of the Service without our written permission.

6. Fees and Payment

The Service is free for most features. Certain features—such as linking bank accounts through Plaid—may incur a small fee to cover secure third-party integration costs. These costs are pass-through charges from our integration provider and are non-refundable and non-prorated.

When you add a new linked account, you will be charged the full applicable amount immediately, regardless of the date within your current billing cycle. That account will also be included in your next recurring billing cycle. If you remove a linked account before your next billing date, no partial credits or proration will apply.

You will be notified of any applicable fees before confirming a payment. All payments are processed by trusted third-party providers (e.g., Stripe). FreeBudget does not store or process your payment information directly.

6.1 Subscriptions & Auto-Renewal Consent

Some features may be billed on a recurring basis (e.g., per linked account). By starting a paid plan, you authorize recurring charges to your payment method at the then-current price and billing interval until you cancel. Plans auto-renew each period unless canceled. We will provide at least 30 days’ advance notice of price increases or material plan changes.

As described in Section 6, fees for linked accounts are non-refundable and non-prorated. Adding a linked account may trigger an immediate full-period charge, which will also apply on subsequent renewals until the account is unlinked.

6.2 Cancellations

You can cancel at any time in the app by unlinking your accounts or deleting your profile (Profile & Billing → Delete Account) or by emailing support@freebudget.org

6.3 Refunds

Except where required by law, fees are non-refundable and no credits are provided for partial periods or unused services. We will issue a refund or credit if: (a) we duplicate-charge you or; (b) there is confirmed fraudulent use of your payment method. Approved refunds are returned to the original payment method.

Because integration fees are billed in full upon linking and are not prorated, no refunds or credits will be issued based on when a linked account was added within a billing period.

6.4 Billing Disputes & Chargebacks

Contact support@freebudget.org within 30 days of the charge to dispute a billing issue. If you initiate a chargeback, we may suspend or terminate access while we investigate and may contest improper chargebacks.

7. Termination

You may delete your account at any time by contacting support@freebudget.org or using available in-app controls. We may suspend or terminate your access at our discretion, with or without notice, including for violations of these Terms. Provisions that by their nature should survive termination (e.g., indemnification, disclaimers, and limitations of liability) shall survive.

8. No Financial, Tax, or Investment Advice

The Service provides tools and information for educational purposes only and is not financial, investment, legal, or tax advice. FreeBudget is not a fiduciary, advisor, or broker. You are solely responsible for decisions you make using the Service.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that third-party data will be accurate or available.

10. Limitation of Liability

To the maximum extent permitted by law, FreeBudget is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us, if any, in the three (3) months before the claim arose.

11. Indemnification

You will defend, indemnify, and hold harmless FreeBudget and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law principles. Venue and jurisdiction for any non-arbitrable disputes will be exclusively in the state or federal courts located in South Carolina.

13. Dispute Resolution & Arbitration; Class-Action Waiver; Opt-Out

Binding Arbitration. Except for claims that may be brought in small claims court, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) before a single arbitrator under the AAA Rules. The arbitration will be held in South Carolina, or by videoconference as the arbitrator permits.

No Jury Trial; No Class Actions. You waive the right to a jury trial and to participate in class or representative actions; disputes will be resolved individually.

30-Day Opt-Out. You may opt out of this arbitration agreement by emailing support@freebudget.org within 30 days of first accepting these Terms with your name, email, and a clear statement that you wish to opt out of arbitration. If you opt out, Section 12 governs.

This Section survives termination of your account and the Terms.

14. Third-Party Services

The Service may integrate with third-party services (e.g., Plaid for account connections, Stripe for payments). Those services are governed by their own terms and privacy policies. We are not responsible for third-party content, accuracy, or availability.

15. User Content & Feedback

If you submit content (e.g., labels, notes, attachments), you grant FreeBudget a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content solely to operate and improve the Service. If you provide feedback or suggestions, we may use them without restriction or compensation.

16. Aggregated & De-identified Data

We may use information about your use of the Service in aggregated and/or de-identified form for analytics, benchmarking, and to improve the Service. We will not attempt to re-identify aggregated or de-identified data without your consent and we will not sell your data to third parties.

17. Data Retention & Deletion

Upon account deletion, we will disable access promptly and delete or de-identify personal data within a commercially reasonable period, except where retention is required by law, tax, compliance, fraud prevention, or security. You may request deletion by emailing support@freebudget.org.

18. Children

The Service is not directed to children under 13 and may only be used by individuals 18 or older.

19. Service Changes; Beta Features; Availability; Force Majeure

We may modify, suspend, or discontinue features at any time. From time to time we may offer beta or experimental features provided as-is and subject to change. The Service may be unavailable during maintenance or due to events beyond our reasonable control (force majeure).

20. Modifications to These Terms

FreeBudget may update or modify these Terms at any time, at its sole discretion. We are not obligated to provide prior notice of such changes. Any updates will become effective immediately upon posting unless otherwise specified.

We encourage you to review these Terms periodically. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

21. DMCA / Copyright Complaints

If you believe content on the Service infringes your copyright, notify support@freebudget.org with: (1) identification of the copyrighted work; (2) identification and location (URL) of the allegedly infringing material; (3) your contact information; (4) a statement under penalty of perjury of your good-faith belief that the use is unauthorized; and (5) your physical or electronic signature. We may remove content and terminate repeat infringers.

22. Assignment; Waiver; Severability; Notices; Entire Agreement

  • Assignment. You may not assign or transfer these Terms; we may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.

  • Waiver. A failure to enforce any provision is not a waiver.

  • Severability. If any provision is unenforceable, the remainder remains in effect.

  • Notices. We may provide notices via email, in-app messages, or posting within the Service.

  • Entire Agreement. These Terms and any referenced policies (including our Privacy Policy) are the entire agreement between you and FreeBudget regarding the Service.
